AAP alleges selective targeting of its MLAs

IANS | New Delhi |

Alleging selective targeting of its MLAs, the AAP on Thursday said notices of disqualification had been issued to nine of its legislators on the basis of a false complaint.
Aam Aadmi Party leader Dilip Pandey said 27 of its MLAs had been sent notices asking why they could not be disqualified for being members of the Rogi Kalyan Samiti.
Membership of the Samiti did not amount to holding an Office of Profit, he told the media.
More important, he said nine MLAs who had got the notices, the Delhi assembly Speaker included, were not even members of this body, Pandey said and alleged a conspiracy against the AAP.
“Imagine the harassment these MLAs have undergone for no fault of theirs,” he said. “Who will take action against the people who have acted in a malafide manner against our MLAs?”
He alleged that even a basic scrutny of the complaint against the MLAs was not done before the notices were issued.
Pandey blamed the Modi government and the Bharatiya Janata Party for the “conspiracy”.
The Election Commission on November 2 issued show-cause notices to 27 AAP MLAs on a petition seeking their disqualification for allegedly holding Office of Profit.
“People with an anti-democratic framework of mind are misusing reputed institutions for short term political gains,” Pandey said.
Pandey said the Rogi Kalyan Samiti (RKS) chairperson and members were exempt from the Office of Profit under The Delhi Members of Legislative Assembly of Delhi (Removal of Disqualification) Act, 1997.

Tweets of winged visitors

More than one lakh migratory birds from Central Asia to Russia and Siberia fly to the Pong dam for roosting and feeding at the water reservoir till the end of March

Statesman News Service | Shimla |

With winters setting in, the tweets of winged visitors from overseas have again livened up the secluded and picturesque Pong dam wetland in Kangra valley of Himachal Pradesh.

The migratory birds fly from entire central Asia to Russia and Siberia to roost at the water reservoir, also named as the Maharana Pratap Sagar dam.

It is the largest man made wetland, measuring 314 square kilometres in the foothills of Himalayas and is located at a distance of around 300 kilometres from Shimla.

The birds start arriving at Pong wetland by the end of September every year and stay there till the onset of winters. Barring few years, in normal course, more than a lakh waterfowls of different species come to the reservoir for their sojourn, turning the area into a bird watchers’ paradise.

“Around 15000 birds have already arrived as per the bird census done by us on October 28. Many more would be recorded as they keep coming and their numbers usually swell up by December, January,” DS Dadwal, Assistant Conservator, Pong and Divisional Forest Officer (Headquarters), Wild Life Circle, Dharamshala told The Statesman.
“The migratory birds roost and feed here till March end. Majority of them fly back then. Some species stay back for more time if the cold conditions prevail,” Dadwal said.
The wild life wing of Himachal has been keenly studying the pattern of migratory birds through ringing of birds and their behavioral pattern through collars over the past some years. Dadwal has been involved in the exercise, keeping with his knowledge of the subject.
Migratory birds including the bar-headed geese, coot, common pochard, red-crested pochard, great cormorant, gadwall, northern pintail, river tern and the spotbill duck are usually spotted at the reservoir every year.
Other species, which are seen near the waters in Pong are common shelduck, the greater white fronted goose, the black bellied tern, the Sarus crane, the lesser white-fronted goose, the osprey, the buff bellied pipit and water rail.
These species are not common visitors in other wetlands in India. As per wild life officials, the influx of the bar-headed geese can be spotted in marshy areas along the reservoir like Nagrota Suriyan, Nandpur Batoli, Chatta, Jambal and the island in the Pong dam.
Pong wetland is also home to many native birds like the red jungle fowl, large Indian parakeet, Indian cuckoo, bank mynah, wood shrike, yellow-eyed babbler, black ibis, paradise flycatcher, crested lark and the crested bunting.
A total of 423 species of birds, 18 species of snakes, 90 species of butterflies, 24 species of mammals and 27 species of fish have so far been recorded in the Pong Dam wildlife sanctuary.
The highest number of winged guests ever recorded at Pong dam has been 1.5 lakh. Last year, the number was 1.06 lakh.

Setback for Punjab as SC strikes down law axing water-sharing

IANS | New Delhi |

In a setback to Punjab, the Supreme Court on Thursday held as unconstitutional the state's 2004 law intended to deny Haryana its share of Sutlej-Yamuna water. Holding the Punjab Termination of Agreement Act, 2004, not in conformity with the provisions of the Constitution, the constitution bench of Justice Anil R. Dave, Justice Shiva Kirti Singh, Justice Pinaki Chandra Ghose, Justice Adarsh Kumar Goel and Justice Amitava Roy answered in the negative all the four questions referred to the top court in a Presidential reference. While Justice Dave pronounced the opinion for the majority of the judges, Justice Singh, while agreeing with the majority view, gave his own observations.  At the initiative of the then Congress government headed by Amarinder Singh, the Punjab assembly had unanimously passed the law terminating all the agreements with the states of Haryana, Rajasthan, Himachal Pradesh, Jammu and Kashmir, Chandigarh and Delhi on the sharing of Sutlej-Yamuna river water.  This act was brought to tide over the January 15, 2002 apex court judgment and decree and subsequent judgment and order of June 4, 2004. While answering the Presidential reference in the negative, the court refused to extend its interim order of March 17, 2016 by which it had appointed receivers under the Union Home Secretary to ensure that farmers' land that was acquired for constructing the Sutlej-Yamuna Link canal was not disturbed.  The Punjab assembly had also passed a law for returning the farmers land acquired for the canal.

Tata Sons hits out at Mistry; accuses him of betraying trust

PTI | Mumbai |

Launching a scathing attack on ousted chairman Cyrus Mistry, Tata Sons today accused him of betraying trust and trying to seek control of main operating firms of the over $100 billion group.
In a nine-page statement, the promoter of the major operating Tata companies made a point by point rebuttal to the letter which Mistry had written to its board members a day after he was ousted on October 24.
Tata Sons accused Mistry of trying to gain control of the Indian Hotels Co Ltd – the firm that runs Taj Group of Hotels – by using independent directors.
Mistry-headed IHCL, where Tata Sons holds just 28.01 per cent stake, had last week in a filing to stock exchanges stated that independent directors have backed the Chairman and his leadership.
“In hindsight, the trust reposed by Tata Sons in Mr Mistry by appointing him as the Chairman four years ago has been betrayed by his desire to seek to control main operating companies of the Tata group to the exclusion of Tata Sons and other Tata representatives,” the Tata Sons statement said.
Tata Sons said dividend from 40-odd Tata Group firms had declined during Mistry's tenure while expenses have risen. It accused Mistry of demolishing the historic management structure where Tata Sons exercised control over its group companies.
“We now have an unacceptable new structure where the Chairman alone is the only common Director across several companies and this situation could not be allowed to go on,” it said.
Punching holes into Mistry's performance over four years, it listed Tata Steel Europe, DoCoMo-Tata Tele joint venture and Tata Motors' Indian operations as “problem companies” where there was no “noticeable improvement in operations” and the situation has worsened with widening losses, increasing debt and declining market share.
“Even with no turn-around…the only action taken was to write-off huge amounts against these companies,” it said.
Mistry had in his letter to the Directors warned of Tata Group firms facing Rs.1.18 lakh crore write-offs.
Tata Sons said the group's debt has risen by Rs.69,877 crore to Rs.2,25,740 crore in the last four years and went on to point that the buyer of Tata's European steel assets had dramatically turned around the company in the very first year.
It lashed out at Mistry's handling of the crisis at Tata Steel Europe and the stand-off with Japan's DoCoMo over the failed telecom joint venture where Tatas face USD 1.17 billion penalty for violation of contract.
Referring to Mistry's allegations in his letter to its board members that five major Tata firms may have to take potential write downs of Rs.1.18 lakh crore, Tata Sons questioned whether he had informed the respective boards of these companies and why was it not made public.
Arguing that he could not have 'discovered' such a large potential liability only a day or two after he was replaced, Tata Sons said, “It also suggests that he had no intention of or given up any attempt to revive the value of these companies.”
Refuting Mistry's accusation of interference by the Tata Trusts, Tata Sons said it “was not only wrong in reality but has been twisted to mislead people”.
It was only to to protect the assets of the Trusts – the most important and valuable being investments in Tata Sons — that information relating to the operations of the company, which is an unlisted investment holding company need to be kept track of, it said.
Citing that there has been continuous decline in the income of Tata Sons from its large portfolio of investments other than TCS during the last four years of Mistry's regime, the statement said it reflected the corresponding decline in the many operating companies in which Tata Sons holds a significant shareholding.
Dividends received from all the other 40 companies excluding TCS has continuously declined from Rs.1,000 crore in 2012-13 to Rs.780 crore in 2015-16, including additional interim dividend of Rs.100 crore.
“While dividend income was declining, expenses (other than interest on debt) on staff increased from Rs.84 crore to Rs.180 crore and other expenses increased from Rs.220 crore in 2012-13 to Rs.290 crore in 2015 (excluding exceptional expenses),” Tata Sons said in its statement.
It further said impairment provisions increased from Rs.200 crore in 2012-13 to Rs.2,400 crore in 2015-16 “indicating inability to stem falling values and turn around the 'hot spots' referred to by Mr Mistry”.
On the group's automobile venture, Tata Motors, Tata Sons said that during Mistry's leadership “there has been a perilous drop in market share in both passenger cars and commercial vehicle areas over the past three years”.
“In passenger cars, in the year ended March 2013, the market share was 13 per cent which now stands at 5 per cent! …However, even more concerning is the market share in commercial vehicles which in March 2013 stood at 60 per cent and now stands at (over) 40 per cent the lowest in the company's history as the market leader in commercial vehicles,” Tata Sons said.
While it did not make any mention of Nano, Tata Sons said the problems of Tata Motors are “masked by the performance and profitability of JLR as most references to Tata Motors are in consolidated form”.

Will demonetisation affect ‘Rock On!! 2’?

IANS | Mumbai |

Prime Minister Narendra Modi's move to demonetise high value currency notes will not have any effect on the release of Rock On!! 2, says actor-filmmaker Farhan Akhtar who feels nothing can stop the audiences from coming to theatres once they decide that a film needs to be watched. Farhan, who plays one of the leads in Rock On!! 2 and is also the film's co-producer, wonders if there is ever the perfect time to release a film. “Finally, it's not about how much you market your film. If intense marketing helped sell a film to the audience, every film would be a hit. I feel the public makes up its mind whether it wants to see a film or not early in the process of a film's marketing. If they've decided they want to see a film, nothing can stop them,” he said. After Modi announced scrapping of Rs.500 and Rs.1,000 notes, there was a buzz that the makers of Rock On!! 2 were contemplating postponing its release to avoid the immediate backlash of the currency shortage among consumers. “Wrong,” said producer Ritesh Sidhwani, and added: “We are releasing on schedule this Friday.” In fact, cinema hall chain PVR Cinemas has decided not to charge convenience fee on usage of a debit or credit card for purchase of tickets for Rock On!! 2. Also, Paytm has started a 'buy one, get one free' offer for the first week of the movie's release.

Indian Ocean’s widening current to impact climate change

The findings suggest that intensifying winds in the region may be increasing the turbulence of the current, rather than increasing its flow rate.

IANS | New York |

The Indian Ocean’s Agulhas Current, one of the strongest currents in the world, is getting wider rather than strengthening, which will have important implications for global climate change, a study says.
The findings suggest that intensifying winds in the region may be increasing the turbulence of the current, rather than increasing its flow rate.
“To find decades of broadening, rather than intensification, profoundly impacts our understanding of the Agulhas Current and its future role in climate change,” said study co-author Shane Elipot of the University of Miami’s Rosenstiel School of Marine and Atmospheric Science in the US.
The Agulhas Current flows along the east coast of South Africa, transporting warm, salty water away from the tropics toward the poles.
Using measurements collected during three scientific cruises to the Agulhas Current, the Indian Ocean’s version of the Gulf Stream, the researchers estimated the long-term transport of the current leveraging 22 years of satellite data.
They found the Agulhas Current has broadened, not strengthened, since the early 1990s, due to more turbulence from increased eddying and meandering.
“Increased eddying and meandering could act to decrease poleward heat transport, while increasing coastal upwelling and the exchange of pollutants and larvae across the current from the coast to the open ocean,” Elipot said.
The Agulhas, which is hundreds of kilometres long and over 2,000 metres deep, transports large amounts of ocean heat and is considered to have an influence not only on the regional climate of Africa, but on global climate as part of the ocean’s global overturning circulation.
“Changes in western boundary currents could exacerbate or mitigate future climate change,” lead author of the study Lisa Beal, also a professor at the Rosenstiel School noted.
“Currently, western boundary current regions are warming at three times the rate of the rest of the world ocean and our research suggests this may be related to a broadening of these current systems,” Beal said.

Economic deals to the fore during Modi’s Japan visit

Statesman News Service |

As Indian Prime Minister Narendra Modi starts his three-day
official visit to Japan on Thursday, he will be expecting to see the already
close bilateral relationship rise to a new height, with several major deals set
to be inked.

Among them will be a civil nuclear cooperation agreement,
which allows Japan to export its nuclear plant technologies to India, and one
on India’s purchase of 12 amphibious rescue aircraft from a Japanese
manufacturer worth up to $1.6 billion.

These deals are especially significant given that India has
yet to ratify the international Non-Proliferation Treaty, and that the aircraft
deal will be one of Japan’s first sales of military equipment since it lifted a
50-year ban on arms exports.

The very good personal chemistry between Modi and Japanese
Prime Minister Shinzo Abe is said to have played a part in deepening relations
between the two nations. It is reported that Modi is one of the few people Abe
follows on Twitter. Modi, on his part, first visited Japan back when he was
chief minister of India’s Gujarat province.

It would be just another diplomatic anecdote if it stopped
there.

Yet some have tried to describe the visit as a mutual effort
by New Delhi and Tokyo to “counter an assertive China”, or “to
keep a rising China in check”. They hope that an anti-China alliance could
be forged between the world’s second most populous nation and third-largest
economy, because of China’s longstanding territorial dispute with India and its
spat with Japan over the Diaoyu Islands in the East China Sea.

People with such thinking have too simplistic an idea of
international relations that are not a zero-sum game.

Modi has always sought “to lead India’s foreign policy
with its economic interests in mind”. And Japan’s trade with India is
still less than a quarter of that between India and China.

China, as the top trade partner of both, is more than happy
to see deepened economic, trade and political relations between its neighbors
if they contribute to peace and stability in the region.

While some in Japan may continue to trumpet “the rule
of law in the South China Sea” or “freedom and openness in the Indian
and Pacific Oceans”, as Abe did with Modi in September on the sidelines of
a meeting of the Association of Southeast Asian Nations in Laos, Sino-Indian
relations are strong enough to withstand differences and external
interferences.

China launches pulsar test satellite

The satellite, designed by academies affiliated to the state-owned China Aerospace Science and Technology Corp, took off at 7.42 a.m from Jiuquan launch base in the Gobi desert.

IANS | Beijing |

China
on Thursday successfully launched a satellite into space to detect signs of
pulsar, which are very high density stars formed exclusively by neutron.

The satellite, designed by academies affiliated to the state-owned China
Aerospace Science and Technology Corp, took off at 7.42 a.m from Jiuquan launch
base in the Gobi desert.

The satellite launch was conducted on a Long March-11 rocket which debuted last
year.

Upon entering the orbit, the satellite will conduct tests on signal and
adaptation to the space environment.

The pulsar, born of supernovae explosions, emits electromagnetic radiation on a
regular basis.

Neutron stars also rotate at high speed and have a slightly greater mass than
the sun but concentrated within a radius of 10 km approximately, which gives
them a high density.
