EC bribery case: Delhi HC dismisses middleman’s bail plea

The Delhi High Court on Thursday rejected the bail plea of a middleman, arrested in the Election Commission bribery case allegedly involving AIADMK leader TTV Dhinakaran and others.

Justice Mukta Gupta dismissed the bail application of middleman, Sukesh Chandrashekar, who was arrested on April 16last year and was denied bail once by the high court and thrice by the trial court.

The Delhi Police had opposed his bail plea saying his conduct, even while in custody, had shown scant respect for the law and therefore, he should not be granted the relief.

Additional Public Prosecutor Hirein Sharma had told the court that three more cases were registered against Chandrashekar while he was in custody and there were a total of 24 FIRs lodged against him.

Referring to the new FIRs lodged against him while he was in custody, the prosecutor had said while Chandrashekar was supposed to be taken by train, he was going by air along with nine policemen, all of whom were dismissed from service.

The lawyer had also claimed that the accused had made a call to the trial court judge hearing the case, impersonating a person from a Supreme Court judge’s office and asked her to release him on bail.

The call was traced to a constable’s phone while Chandrashekar was in custody, the prosecutor alleged.

Senior advocate Sudhir Nandrajog and advocate Anand Pandey, appearing for Chandrashekar, had contended that the alleged main beneficiary, Dhinakaran, was already out on bail and the same relief was granted to the policemen.

They said the other accused in the case, including Dhinakaran’s close aide Mallikarjuna, as well as suspected hawala operators Nathu Singh and Lalit Kumar were on bail.

The high court had on June 15 last year rejected his bail plea on the ground that the police had seized a fake Rajya Sabha member ID card from his possession.

A charge sheet was filed by the police before the trial court in the case on July 14 last year, alleging that Dhinakaran and Chandrashekar had conspired to bribe Election Commission (EC) officials to get the ‘two leaves’ symbol for their party.

The police have also included in the charge sheet allegations of forgery for purpose of cheating, using the forged document as genuine, possessing a forged document, intending to use it as a genuine and criminal conspiracy.

Chandrashekar has also moved a separate plea in the high court alleging he was tortured despite an order not to subject him to violence inside the Tihar Jail where he is in custody.

The claim was denied by the jail authorities, who said it was an “afterthought of the shrewd mind of the accused”.

Chandrashekar was arrested for allegedly taking money from Dhinakaran to bribe EC officials to get the AIADMK ‘two leaves’ symbol for the Sasikala faction in a by-election to the R K Nagar Assembly seat in Tamil Nadu.

Dhinakaran, also charge-sheeted by the police, was arrested here on April 25 after four days of questioning for allegedly attempting to bribe EC officials for the symbol. The bypoll was necessitated by the death of Tamil Nadu CM J Jayalalithaa, who represented the assembly segment.

The EC had frozen the AIADMK’s symbol after the two factions–one led by Dhinakaran’s aunt Sasikala and the other by former chief minister O Panneerselvam–staked a claim to it.

Mallikarjuna was arrested for allegedly facilitating a Rs 50 crore deal between Dhinakaran and Chandrashekar.

Girls outshine boys in J-K higher secondary school exam

Girls outshone boys in the Higher Secondary School Examinations conducted by the Jammu and Kashmir Board of School Education (BOSE).

The results for the same were declared on Thursday.

According to BOSE officials, 33,893 of the 55,163 candidates qualified the examination held in November last.

While the overall pass percentage was 61.44, more girls (64.31 per cent) passed the examination compared to boys (58.92 per cent), they said.

BJP, RSS people are Hindutva terrorists: Karnataka CM Siddaramaiah

As the political slugfest intensifies in poll-bound Karnataka, Chief Minister Siddaramaiah on Thursday said members of the BJP and RSS were “Hindu terrorists”, a day after he accused the saffron party of “harbouring extremists”.

Talking to the media, the Karnataka CM said: “What I had said was that BJP (Bharatiya Janata Party) and RSS (Rashtriya Swayamsevak Sangh) people are Hindutva terrorists.”

The statement comes a day after Siddaramaiah said the BJP, RSS and Bajrang Dal were harbouring extremists.

Addressing the media in Chamarajnagar, the chief minister had said: “They are also extremists of one kind. BJP, RSS, and Bajrang Dal have extremists. Anybody who spoils communal harmony will not be tolerated.”

Later in the day, BJP chief Amit Shah hit back at the CM and accused him of being anti-Hindu and indulging in vote-bank politics.

At a rally in Holalkere town in Chitradurga district, Shah said: “Over 20 workers of BJP and RSS have been murdered in three years. What was their crime? This government is not even investigating it.”

“This government is practicing vote-bank politics and it is anti-Hindu. It has taken back all the cases against the Social Democratic party of India, an anti-national and fundamentalist organisation,” Shah added.

Assembly elections in Karnataka are likely to be held in May and the BJP is going all guns blazing to oust the Congress from the state and has set itself a target of 150 seats.

The party is planning to launch a two-front attack on the incumbent Congress with Shah along with Uttar Pradesh Chief Minister Yogi Adityanath consolidating Hindu votes while Modi, with a blitzkrieg of rallies later, will woo the urban voters.

The Congress and the BJP had won 122 and 40 seats respectively in the last assembly polls.

 

Bangladeshi immigrant indicted for New York subway bomb attack

A Bangladeshi immigrant has been indicted on terrorism charges in the US for last month’s botched bombing in a New York City subway station.

Akayed Ullah, 27, would face life in prison if convicted of the attack in a passageway near the Port Authority bus terminal on December 11 that left three persons injured.

Ullah, 27, who was also injured in the explosion, has been in federal custody since his arrest.

He will be arraigned before Judge Sullivan.

The federal grand jury indicted Ullah yesterday with one count of providing and attempting to provide material support to the Islamic State of Iraq and al-Sham (ISIS), and one count of using and attempting to use a weapon of mass destruction.

He has also been charged with one count each of bombing and attempting to bomb a place of public use and a public transportation system; destruction and attempted destruction of property by means of fire or explosives; conducting and attempting to conduct a terrorist attack against a mass transportation system.

“As alleged in the indictment Akayed Ullah constructed a pipe bomb and detonated it in a mass transit hub in the heart of New York City to terrorise as many people as possible and to bring ISIS-inspired violence to American soil,” said Acting Assistant Attorney General Dana Boente.

Ullah migrated from Bangladesh some six years ago on a family visa.

He was sponsored by his uncle, who came to the US through diversity lottery visa.

Since then US President Donald Trump has been pushing for end to chain migration and diversity lottery visa.

He began to self-radicalise three years ago, authorities said, but law enforcement said he was not on their radar before the subway attack.

Locking stable after horses have bolted: P Chidambaram on Aadhaar

Congress leader P. Chidambaram on Thursday said the government’s new measure to secure Aadhaar data was meaningless because the damage has been done as millions of citizens have already shared their unique ID number with service providers.

“Under compulsion, millions of persons have already shared Aadhaar number with many service providers. New security layer is like locking the stable after horses have bolted,” the former Finance Minister tweeted.

The UIDAI, which collects and manages Aadhaar data including biometrics of citizens, on Wednesday announced a new two-layer system to strengthen security under which citizens would no longer be required to share their unique IDs for verification purposes.

This was done to address privacy concerns after a news report claimed a breach in the Aadhaar database.

Under the new system, at the user-end, the Aadhaar holder will have the choice not to share their Aadhaar number at the time of authentication.

Instead, a random 16-digit Virtual ID number would be generated and could be used in lieu of Aadhaar with the authorised agency like banks and telecom service providers.

Mamata wishes Nobel laureate Kailash Satyarthi on 63rd birthday

West Bengal Chief Minister Mamata Banerjee on Thursday wished Nobel laureate child rights activist Kailash Satyarthi on his 63rd birthday.

Bengal CM Banerjee took to Twitter to wish Satyarthi on his birthday.

Satyarthi was born in Vidisha in Madhya Pradesh. He holds a degree in electrical engineering as well as a post-graduate diploma in high-voltage engineering.

Satyarthi’s work has been recognised through various national and international honours and awards including the Nobel Peace Prize in 2014, which he shared with Malala Yousafzai of Pakistan.

Kailash Satyarthi is an children’s rights activist. He is the founder of Bachpan Bachao Andolan, the Kailash Satyarthi Children’s Foundation, Global March Against Child Labour, and Good Weave International.

Till date, Satyarthi’s Bachpan Bachao Andolan has liberated more than 86,000 children children in India from child labour, slavery and trafficking.

Satyarthi was among Fortune magazine’s ‘World’s Greatest Leaders’ in 2015 and was also featured in LinkedIn’s Power Profiles List in 2017.

Dutch Olympic cyclist in coma after accident

Dutch Olympic cycling silver medallist Jelle van Gorkom is in coma following a crash, officials said.

The 27-year-old, who won a silver in the Rio Olympic Games, was hurt after an accident during training at the national sports center at Papendal near Arnhem on Wednesday, reports.

“After the accident, Jelle van Gorkom was taken to hospital. He has broken ribs, a fracture to the face, a tear in the skull and damage to the liver, spleen and kidneys,” said a statement on the Royal Dutch Cycling Union website.

Kashmiri militants killed by Indian forces are ‘martyrs’, says PDP MLA

Peoples’ Democratic Party (PDP) legislator Aijaz Ahmad Mir on Thursday landed in controversy after describing the Kashmiri militants killed by Indian security forces as martyrs.

Adding fuel to the controversy, the Wachi MLA added that the deaths of militants must not be celebrated and people should sympathise with parents of militants along with jawans.

“Militants who are from Kashmir and get killed are martyrs, they are our brothers, and some of them are minors who don’t even know what they are doing,” Mir told the reporters in Jammu and Kashmir outside the state Assembly.

“We should not celebrate the killings of militants, it is our collective failure, we feel sad when our security forces are martyred as well, we should sympathise with parents of jawans and with parents of militants as well,” he added.

Just a day before on Wednesday, Mir had termed Kashmir militants as his brothers. He went on to demand talks with the Hurriyat and militants in a bid to resolve the Kashmir issue permanently.

Mir’s statement has not gone down well with the party’s ally Bharatiya Janata Party. In a stinging response, Union Minister Mukhtar Abbas Naqvi said, “Terrorists and separatists are enemies of Kashmir, Kashmiris, development and peace. How can they be someone’s brother?”

Apart from Maroulis, it was Harphool played a crucial role as he  won his  bout to increase Haryana’s lead to 4-2 and seal Marathas fate with one bout remaining.

In the high-profile clash of the day, Helen took on Rio Olympics Bronze medalist Marwa Amri of Tunisia in the women’s 57 kg competition. However it turned out to be a lopsided affair with the US wrestler completely dominating her opponent to win the bout 9-1 by pinfall.

The fifth bout of the day between Amit Dhankar and Harphool in the 65 kg turned out to be the most exciting duel of the night. Both the wrestlers were at the top of the game and ended the bout 5-5. However, it was Harphool who adjuged the winner by the virtue of winning the last point of the bout.

Russian Khetik Tsabolov then added more insult to Marathas injury after he beat  Parveen Rana 10-0 in 74 kg affair in the last contest of the day.

2017 World Championship silver medalist Vasilisia Marzaulik of Belarus and ICON player of the Marathas brought her team back into the tournament after she pinned India’s Pooja to win the match 8-0 in the 76 kg in the opening period of the bout itself.

The Indian was no match for the Armenian and could hardly mount any challenge and went down meekly to wipe her team’s advantage.

In biggest drive, SDMC seals 135 shops on Lodhi Road

In a massive crackdown on unauthorised constructions in the national capital, the South Delhi Municipal Corporation (SDMC) sealed upper floors and basements of 135 shops in the posh Meher Chand Market on Wednesday.

Besides, two PSU banks were been given two days to wind up their operations, a senior SDMC official said.

Wednesday’s drive was termed the biggest by the civic body following instructions of a Supreme Court-appointed monitoring committee.

“Sealing action was taken in 135 of the 153 shops in Meher Chand Market, Lodi Road, but ground floors were spared. Only upper flowers and basements built or used in violation of civic norms were sealed. Two banks, State Bank of India and Dena Bank, have been given two days to wind up their operation,” the official said.

The ground floors, built legally, have been spared, he added. Meher Chand Market is home to many plush eateries and boutique shops and known to have a good foothall.

In nearby upscale Khan Market, the New Delhi Municipal Council (NDMC) on Tuesday sealed 16 commercial establishments for unauthorised construction. A day earlier the civic body had sealed terraces and open spaces of eight major establishments in Khan Market.

On January 5, as many as 56 establishments, including showrooms of automobile majors, in South Delhi’s Vasant Kunj were sealed by the SDMC for “misuse” and “encroachment” of property.

Congress, Left accuse TMC of practising ‘soft Hindutva’

The ruling Trinamool Congress has come under sharp criticism from the Congress and the Left for toeing a “soft Hindutva” line, a move that the BJP has described as an attempt to arrest the consolidation of Hindu votes in favour of the saffron party.

The TMC, in its defence, said that the BJP doesn’t have a copyright to Hindutva.

“What the BJP is preaching is not Hinduism. They just want to divide the society. We want to take along all communities and religion and move forward,” a senior TMC leader said.

The issue came to the fore in the wake of the TMC organising a “Brahmin convention” in Birbhum district earlier this week. Thousands of priests were felicitated at the programme and each of them was given a copy of Bhagavad Gita, a shawl and pictures of Sri Ramakrishna and Ma Sarada.

The Congress and the Left parties alleged that the recent surge in the BJP’s vote share in the state byelections has forced the TMC to practise “soft Hindutva” and woo the Hindu voters.

The leader of Opposition in the State Assembly Abdul Mannan said, “Politics driven by religious compulsion is a dangerous trend and will destroy the communal harmony of the state in the long run.”

The state CPI(M) leadership also expressed apprehensions that the “competitive communalism practised by the TMC and the BJP” in Bengal may have dangerous consequences.

“The TMC is feeding minority fundamentalism whereas the BJP is feeding majority communalism. Now the TMC is trying to beat the BJP in its own game of Hindutva with an image makeover,” CPM MLA Sujan Chakrabarty said.

Since the party came to power in 2011, the TMC was accused by the BJP of appeasing the Muslim community which comprises around 30 per cent of the total electorate in the state. Various decisions by the TMC government such as allowances to imams and muzzeins were seen as an attempt to appease the minorities.

Senior TMC leader and MP Saugata Roy said working for various communities “is part of the TMC’s policy” and it has nothing to do with appeasing a particular community.

“It has nothing to do with appeasing anyone. The TMC stands for secularism,” Roy told PTI.

When asked about the TMC organising the Brahmin convention, Roy said, “This is an isolated incident. You should not draw any conclusion from it.”

TMC’s Birbhum district president Anubrata Mondal, the prime organiser of the Brahmin convention, had said the programme was arranged to highlight the “misinterpretations” of Hinduism by the BJP and discuss what the Hindu religion stood for.

“The BJP doesn’t have a copyright to Hindutva,” another TMC leader said.

The BJP state leadership, however, said the fear of consolidation of Hindu votes under it has forced the TMC to change its political line.

“From the rise in our party’s vote share in last few bypolls, the TMC has understood that Hindus are uniting under the BJP’s leadership. That is why they are now trying to please the Hindus,” BJP national secretary Rahul Sinha said.

State BJP president Dilip Ghosh said the TMC had realised that it would no longer be able to win elections just by appeasing the Muslims and was trying to woo Hindus with an “image makeover”.

I-T collection up 13% in Bengal and Sikkim in Apr-Jan

Income Tax collection in West Bengal and Sikkim circle has witnessed 13 per cent growth in the current fiscal till now and the department is optimistic about achieving the target.

The target for 2017-18 is Rs 41,891 crore and the department has been able to collect 69 per cent of the target till now, a top income-tax official said.

“As on date, we have collected nearly Rs 29,000 crore.

Tax collections have gone up by around 13 per cent this year and we can achieve the target, principal chief commissioner of income-tax for West Bengal & Sikkim, K L Maheshwari said.

In the corresponding period of the last fiscal, I-T collections had been Rs 25,500 crore against a target of Rs 35,500 crore for 2016-17, Maheshwari said.

However, there had been a decline in the share of TDS or tax deductions at source in overall collections due to centralisation of TAN or tax deduction and collection account number by banks.

Maheshwari was speaking on the sidelines of the release of ‘Income Tax Pleading and Practice’, a book by Narayan Jain and Dilip Loyalka here on Wednesday.
