India today summoned the Pakistan Deputy High Commissioner, Mr Mansoor Ahmad Khan, to lodge a strong protest against the killing of five Indian jawans by Pakistan across the Line of Control (LoC) in Jammu. Sources in the government said India made it quite clear that it was taking a serious view of the incident and Pakistan needs to investigate and find out as to who is behind these attacks. Mr Khan was summoned sometime in the afternoon, the sources said.
Pakistani troops last night entered Indian territory along the LoC in the Poonch sector in Jammu and Kashmir and ambushed a patrol killing five Indian soldiers.
With the Opposition criticising the government in Parliament today over its ‘soft’ Pakistan policy, the focus is now likely to shift to the effect this is likely to have on India-Pakistan talks. While no dates had been finalised, talks between the two countries were expected to resume on the water issue and Sir Creek, sometime later this month.
Talks were broken off in January this year following the beheading of an Indian soldier in a border clash, in Poonch again. Also, the meeting between Prime Minister Manmohan Singh and his Pakistani counterpart in New York on the sidelines of the United Nations General Assembly (UNGA) session in end-September is likely to now come under a cloud.
Pakistan in the meantime was quick to deny the allegations.
A Press release issued by Pakistan’s ministry of foreign affairs denied the involvement of the Pakistan army in the incident.
"Our military authorities have confirmed that there had been no exchange of fire that could have resulted in such an incident. Pakistan remains committed to the ceasefire agreement of 2003 which is an

‘Players have cheated IPL selectors’

New Delhi, 6 August:  Rajasthan Royals players S Sreesanth, Ajit Chandila and Ankeet Chavan, arrested for their alleged role in spot-fixing during IPL-6, have cheated the selectors, says the charge-sheet filed in the case.
Had it been known that they had agreed to compromise their performances, they would never have been picked, team captain Rahul Dravid has said in his statement to Delhi Police.
"None of the players had ever come forward to bring to the notice of the selectors about anything untoward. Had any of the selectors known that a particular player had agreed to compromise his performance, he would never have been selected for the playing 11," Dravid, a former India captain, told Delhi Police in his statement recorded under Section 161 of the CrPC (Code of Criminal Procedure), the charge-sheet says.
Delhi Police have named 30 people, including the three players, in the charge-sheet, filed on 30 July in a MCOCA (Maharashtra Control of Organized Crime Act) court here. The others are bookies and their associates.     ians

Newborn victim of hospital ‘inhumanity’

A super speciality hospital in Burdwan is refusing to discharge a newborn baby girl as her father has failed to clear her treatment dues.
The Durgapur SDM stepped in after Mr Partha Sarathi Dutta ~ the distressed father ~ complained that the hospital authorities were trying to mint money on the pretext of his baby&’s sickness.
Mr Dutta&’s wife delivered at a nursing home in the City Centre in Durgapur on 25 July.
Following critical asphyxia, the baby was referred to ‘The Mission’ – a super speciality hospital soon after delivery.
Mr Dutta said: “We had mediclaim coverage. Besides, I had deposited Rs 15,000 in cash. The hospital drew Rs 52,000 from that coverage.”
On 1 August, the baby almost recovered from the illness. “I requested the hospital to arrange the release of my baby as medical bills were soaring beyond my reach,” said Mr Dutta. On 1 August, the hospital said the dues stood at Rs 6,000 and on last Saturday it shot up to Rs 24,000. The next day it further climbed to Rs 27,000.
“Today, the hospital said the bill stands at a whopping Rs 1.01 lakh, despite my repeated requests they didn’t release the baby,” he said.
The hospital authorities today said: “The bill should be cleared first and then the baby would be released.”
Mr Probir Mukherjee, CEO, The Mission, told reporters today: “We had told him to clear the dues but he didn’t, we are therefore helpless."
Detaining a patient for the purpose of  extracting money has been frowned upon by the state several times and been declared a forbidden practice.
Mrs Kasturi Sengupta, SDM, considering the gravity of the situation intervened.
The hospital authorities have offered to deduct Rs 5000 from the total bill after the SDM&’s intervention.

Bard had wished to stay in Hyderabad for the rest of his life

This year marks the completion of 80 years of the Nobel laureate, Rabindranath Tagore’s visit to Hyderabad. But the house which treasured the memories of the bard’s memorable visit to Hyderabad in 1933 has fallen prey to the demolition axe of the real estate sector.
Banjara Bhavan, the residence of Nawab Mehdi Nawaz Jung was one of the first houses to be built in Banjara Hills, then a wasteland of formidable rocks.
Jung, a bureaucrat who served under the Nizam, was the first commissioner of the Hyderabad municipal corporation and later served as Governor of Gujarat in 1960. He remained aloof during the Razakar period of 1947-48. In 1927, he purchased 200 acres of land in Banjara Hills. He began construction of the house in 1928.
While offering land to his friends at nominal prices to build their dwellings in the peaceful, rocky terrain, he built his own unique house without demolishing the natural surroundings.
Tagore is said to have been so enamoured with the rock house and its surroundings that he expressed willingness to stay there for the rest of his life, only he had Santiniketan to look after.
He even composed Kohistan and translated it into English during his stay. Jung was also instrumental in naming the area as Banjara Hills after the original inhabitants of the rocky terrain. It is ironic that today Banjara Hills is the most posh residential area in the city while his house has been wiped out of the map of Hyderabad and the Banjaras — the original denizens have come to selling balloons and umbrellas at the traffic signals in and around Banjara Hills.
It was a Grade-I heritage structure according to the first list notified in 1998. "There is nothing left, only some rocks," rued Mr Sajjad Shahid, a heritage activist and a co-convener of INTACH, alleging collusion between the developer and the civic body. "Otherwise the denotification and demolition notice cannot take place on the same day. The government offices do not act so fast," he said.
The Forum for Better Hyderabad had moved the High Court and got an order for maintaining status quo but a visit to the site at Road Number 4 reveals ample activity with men and machine behind the white screens that have been set up, possibly after all the hue and cry.
Also, private security guards have been posted. Even locals are not aware of the rich history and most people looked gaping when asked about Banjara Bhavan. There is not even a plaque to remind people of its rich history.

South Corporation is playing with education, alleges councillor

In a heated debate over primary education in municipal schools, an NCP councillor expressed his dismay with the policy makers and alleged that the Corporation is playing with the promising pillar of the country.
Today, the house meeting of the South Delhi Municipal Corporation (SDMC) witnessed bedlam, when councillor Jeevan Lal expressed his discontent over the policy of education in the Municipal schools. He alleged that the preparations for the same are on for a year now, but are in paper only. No substantial reform or change has taken place.
"The policy for the development of the Corporation schools is virtually hanging in fire. Politicians have been promising quality education solely for getting political mileage for the upcoming assembly elections," said Mr Lal. 
He put forth several examples which had been committed last year by the BJP-ruled Corporation such as CCTV surveillance cameras, security guards, benches and water purifiers, but are yet to see light. Mr Lal also said that in many schools children are doing the cleaning.  He also said that the corporation is listing those  parent-teacher association (PTA) members who are already dead, in the mid-day meal testing committee.  
"The civic body is including the names of those PTA members who are either absent or are not alive," said a Congress councillor and the central zone chairman, Mr Virendra Ksana. He also said that more than 15 schools are being run in porta cabins.  A BJP lady councillor warned that a school building in Nawada in South West Delhi is in a dilapidated condition, and this may lead to some untoward incident. 

16/12 gang-rape: Prosecution alleges father of one accused deposing falsely

The prosecution in the 16 December gangrape case today alleged that the father of one of the accused is deposing falsely.
 Additional Sessions Judge Yogesh Khanna, who resumed the trial in the case after a week-long gap, has recorded the statement of two defence witnesses on behalf of Akshay Thakur, who have corroborated with his plea of alibi.
 Special Public Prosecutor Dayan Krishnan, however, during the cross-examination of Akshay’s father and the auto driver, said that both the defence witnesses are deposing falsely and are tutored.
 The prosecution’s claim was, however, refuted by the accused father, who said, “On 16 December, 2012, at about 10 a.m, the accused along with his daughter-in-law and grand son had reached his village."
 “It is wrong to suggest that I have concocted false story regarding presence of my son/ accused at my village on December 16, 2012 and also tutored other defence witness to depose at my behest in order to save my son Akshay… It is wrong to suggest that on the incident night, my son was in Delhi and was part of the group of persons, who had allegedly gangraped the girl,” claimed Akshay’s father, while denying the police’s claim that the youth was among the six persons who had gangraped a 23-year-old girl in a moving bus.
Appearing as defence witness, the auto driver claimed in the court that he picked Akshay from the railway station on 16 December last year morning to his village at Aurangabad in Bihar.
 “It is wrong to suggest that since I myself and Akshay belong to the same village, so we have concocted a false story and deposing falsely with regard to presence of the accused in the village,” added the witness.
 During the recording of his statement, Akshay had claimed that he was not in the bus in which the alleged gangrape took place.

33 child labourers rescued

New Delhi, 6 August:  Thirty-three boys between the ages of 7 to 14 years were rescued from shoe and garment manufacturing units in Wazirpur village in North West Delhi on Tuesday in a raid.
Mr Kailash Satyarthi, founder of  Bachpan Bachao Aandolan (BBA) said, “Many major international brands are flourishing at the cost of freedom and education of Indian children and thus destroying their childhood. These brands cannot hide behind the excuse of complexity of supply chain management. They are the principal employers and have to have to be booked under appropriate laws. It should be investigated that, for whom these children are really working.”  Almost every child rescued from the factory had a painful story to tell and an eight-year-old boy, Nandan wept when he kept repeating his desire to go to his home. “He was made to work for more than 12 hours a day in a garment manufacturing unit operating in Wazirpur village in Delhi. He has not seen his family since he was trafficked to the national capital nine months ago. The trafficker deceived his parents into believing that Nandan can earn money in Delhi,” said Mr Satyarthi. 
These children were rescued in a raid by Delhi Task Force, local police, labour department and members of a non-profit organisation, Bachpan Bachao Andolan. These children belong to various districts of Uttar Pradesh, West Bengal and Bihar.                                                                       sns

2G: Prosecution witness alleges CBI threat

A key prosecution witness in a case arising out of the 2G spectrum allocation scam today claimed he was threatened by the CBI that he would lose his job if the investigating officer writes to his employer.
 The statement came during the cross-examination of S Subramaniam, former CFO of BPL Cellular Ltd, by senior advocate S V Raju, appearing for Essar Group promoter Anshuman Ruia, an accused in the case. 
 The court, however, disallowed the question of the defence counsel on this aspect and warned that such queries would be ruled out with a heavy cost.
 “Before ruling could be given on the question, the witness (S Subramaniam) had blurted out the answer. However, question disallowed being in violation of Section 162 CrPC. If such questions are persisted with and are ruled out, the ruling would be accompanied by heavy cost,” said special CBI judge O P Saini.   Raju had asked Subramaniam, “Did the CBI tell you that the investigating officer would write to your employer and you would lose your job?” At this, the witness replied, “That is correct.”  Subramaniam denied the suggestion of defence counsel that he had given his statement under CBI’s “threat” before a magistrate under Section 164 of the CrPC.
 “It is wrong to suggest that I gave my statement under Section 164 CrPC to the magistrate under threat of CBI. It is wrong to suggest that the time of seven days was given to me to plan how to involve Vikash Saraf (an accused) and Essar Group in this case… It is wrong to suggest that I am falsely involving Vikash Saraf and Essar Group in this case because of threat given to me by CBI,” said Subramaniam.
 The statements recorded by a magistrate under Section 164 of the CrPC bind a person and any deviation during the trial would make him liable for prosecution for the offence of perjury.  Subramaniam’s cross-examination concluded today. 
 Essar group promoters Ravi Ruia and Anshuman Ruia and Loop Telecom promoters I P Khaitan and Kiran Khaitan and Essar group Director (Strategy and Planning) Vikash Saraf and three firms, ETHL, Loop Telecom Pvt Ltd and Loop Mobile India Ltd, are facing trial in the case. ETHL and others are facing trial for offence under Section 120B (criminal conspiracy) read with Section 420 (cheating) of IPC, while a substantial charge of cheating has been framed against Saraf.

A city court today framed criminal defamation charges against ex-Delhi BJP chief Vijender Gupta in a complaint filed by Chief Minister Sheila Dikshit. Gupta, however, pleaded not guilty and claimed trial.
 “Charge under section 500 IPC (defamation) is framed against the accused (Gupta) to which he pleads not guilty and claims trial,” said the metropolitan magistrate, Namrita Aggarwal.
 On 1 July, the court had found that prima facie an offence of defamation is made out against Gupta.
 The court also directed Dikshit to appear before it on 28 October to record her evidence against Gupta.
 The said order came on a complaint filed by Dikshit against Gupta alleging that he had used “uncivilised” language against her in the run up to the MCD polls last year while accusing her of helping and conniving with power companies.
 However, in the court today, Gupta pleaded not guilty to the charge and said: “I am feeling humiliated. If you (court) go through the interview, nowhere have I used any defamatory word against the Chief Minister. If I am guilty, put me in jail right away.”
 Meanwhile, the counsel for Dikshit moved an exemption application which was opposed by Gupta’s counsel Ajay Burman saying the date of hearing was already in her knowledge and, therefore, there was no ground for her to seek exemption.
 “I am being harassed as the Chief Minister gets exemption whenever she wants without citing proper reasons while I have to give minor details for seeking an exemption,” said Gupta.
 The BJP leader said when he seeks exemption from appearance, he is acted against while the CM is allowed non-appearance. To this, the court assured him that coercive action would also be taken against Dikshit if she fails to appear on the next date of hearing.
 “As on next date her evidence is to be recorded…. Therefore, whenever the court requires attendance of either the accused or the complainant, they will have to come before it. That court does not favour anyone,” said the court.

Basumati turns 100

CM announces sales tax cut on aviation fuel

To attract airlines for operating more flights from Kolkata, chief minister Mamata Banerjee today announced a 50 per cent cut on sales tax charged on aviation turbine fuel (ATF) if an airline tanks in additional fuel at the Kolkata airport than what it had consumed in the last fiscal.
At Bagdogra, Cooch Behar and the to-be-operationalised Durgapur airport the exemption will be cent per cent for three years.     
However, airlines that have commenced flight operations from Bengal in the current fiscal will not get any benefit.  The effective rate of sales tax on ATF in Bengal is now 30 per cent. The  move will bring it down to 15 per cent for additional fuel purchased at  Kolkata airport and at Bagdogra, Cooch Behar  and Durgapur it will come down to zero. Miss Banerjee said that the incentive is also aimed at increasing investment and business prospects. She handed over a cheque of Rs 15 crore towards the first instalment of a Rs 45 crore-grant to Airports Authority of India for constructing a box culvert over the Mora Torsha river. This culvert is necessary for expanding the Cooch Behar Airport runway. The project is expected to be completed in 30 months.
Meanwhile, Pawan Hans Helicopters Ltd and the Bengal Aerotropolis Projects Limited today inked an MoU at Writers’ Buildings for the latter extending all infrastructure support and services to Pawan Hans for a Kolkata-Durgapur chopper service. An 11-seater helicopter will soon start plying on the route on daily basis.

Prepaid taxi booth to stop passenger harassment

Traffic police opened a prepaid taxi booth at Kolkata railway station to stop harassment of passengers. The other booth at Sealdah station, opened a month ago, is working well, a senior police officer said.
The passengers at Kolkata and Sealdah railway stations are being given a copy of the route from Google map, which the driver of the cab will follow to reach the destination, along with a receipt of the fare and number of the taxi. Both the booths are managed by traffic police personnel.
The map will help the passengers coming to the city for the first time to know the route well. If the driver does not follow the route they can immediately contact police and lodge a complaint. As details of the drivers are already with police, it will not be difficult to book them.  Police officers said the condition of the vehicles at the pre-paid taxi booths are checked so that the passengers travelling are not harassed.
Lauding the move of Kolkata Traffic Police, state transport minister Madan Mitra said: "Earlier passengers at railway stations and airport were often harassed by taxi drivers who charged them arbitrarily. Setting up of such pre-paid booths manned by police personnel will reduce the chance of duping passengers and will project a better image of the city."

State to bring legislation for tourists’ convenience

West Bengal is all set to join the exclusive league of Goa and Kerala by bringing in a specific legislation on tourism to guarantee a minimum standard of services for tourists. The proposed legislation, the West Bengal Tourism (Regulation of Services) Bill, will be tabled in the state Assembly either in the upcoming monsoon session or in the winter session, scheduled for later this year.  
One of the main focus areas of the Bill is to curb ill-equipped tour agencies and lodging facilities in the state that often bring ill repute to Bengal.
The legislation seeks to do so by spelling out the minimum infrastructure and service standard for tour operators, hotels and other lodging facilities; putting in place a set of refund rules; ensuring a grievance redress mechanism both at the service provider level and the civil administration; and making it mandatory for service providers to share information on tourist flow with the state government.      
As of now only Goa and Kerala are the two states in India that have separate legislations on tourism; in case of Goa it is called the Goa Tourist Places (Protection and Maintenance) Act promulgated in 2001 and in Kerala it is the Kerala Tourism Conservation and Preservation of Areas Act promulgated in 2005. 
“We often receive complaints about tourists being overcharged or not provided adequate services. There is also the issue of non-refund of money when a tourist cancels or truncates a trip. The purpose of the proposed legislation is to address all such issues so that tourists are not harassed and there is the guarantee of a minimum standard of services,” said state tourism department principal secretary, Mr Vikaram Sen. 
“Once the Bill is passed, it will become mandatory for tour agencies and hotels to obtain a registration from the tourism department and to avail of the registration, a service provider will have to meet the minimum infrastructure and service standard commensurate to the size and area of their operations,” he said.    
The state at present has about 2050 tour agencies having membership with three private tourism bodies; all of them, as well as the existing lodging facilities in Bengal will be given a time-frame to get themselves registered.
 The state government had in 2012 tried to achieve this goal by invoking the Union government’s Sarais Act 1867, but failed. 
It will also become mandatory on the part of the tour operators and lodging facilities to send a monthly report to the tourism department about the tourists handled by them.
At present, in the absence of any legal binding, it is voluntary process that most service providers do not adhere to and thus; the state government is unable to quantify the actual tourist flow and their origin.

Recently, after the Alipore Zoo officially launched the “Adoption of Zoo Animals” scheme, enthusiasts, including Mr R S Agarwal and Mr R S Goenka of the Emami group adopted a Royal Bengal tiger and an elephant. The zoo has, in initiating this project, followed in the footsteps of many other zoos from across the country and the world. 
But the decision has not gone down well with the relatives who lost their near and dear ones in the fire at the hospital on 9 December 2011. Mr Shyamananda Mukherjee who lost his mother, Mina Mukherjee said: “How come they show their love for animals when they locked patients inside the hospital apprehending non-payment after leaving the hospital?” 
Mr Mukherjee, who lives in Dhakuria, at stone’s throw distance from the AMRI, said that the hospital authorities initially locked the gates and barred local people from entering the hospital for rescuing the trapped patients. “It sounds rather ridiculous that after failing to save life inside their hospital they are investing in zoo.”  Mrs Jaya Ghosh, who lost her husband, Swapan Krishna Ghosh, said that she feel depressed at that news as they are yet to get the compensation of Rs 5 lakh announced by the authorities of AMRI. "It is very unfortunate that the owners forgot what happened to us and are indulging in adopting animals before settling our issues. If they are so sympathetic then why don’t they visit us once to share with us how we are coping now with the situation”  “The enthusiasm to adopt animals appeared to fake in the face of their inhuman attitude during the the incident. None of the officials and staff behaved properly with us when smoke was bellowing out of the hospital. Even they assured us that this is normal,” said Mrs Ratna Bhattacharjee who lost her husband. 
Ms Mahesweta Sen of Emami group said that the decision to adopt animals in zoo is quite different from the fire at AMRI. "It is not correct that we are not settling their dues. The matter is sub-judice and paying compensation would tantamount of buying witness. We have kept aside compensation fund for those who lost their near ones.”  But the relatives are not ready to buy the argument as they said that “gesture matters”.
