Fortis case: Haryana govt to add criminal sections in FIR

A day after an first information report (FIR) was lodged against the Fortis hospital in Gurgaon in connection with the death of a 7-year-old dengue patient, the Haryana government on Monday said  criminal sections in FIR would be added on the basis of irregularities found in investigation report.

The health minister, Anil Vij said besides the sections filed in the FIR, other criminal sections in FIR would be added on the basis of irregularities found in investigation report concerning death of a girl child due to dengue and bill of about Rs 16 lakh.

In this direction, FIR number 639 had already been lodged against the Fortis hospital, Gurugram, he said. The FIR was registered on Sunday against the hospital under section 304 (2) of the Indian Penal Code (IPC) in the SushantLok Police Station (Gurugram).

Vij said that appropriate action would be taken against the hospital management on the basis of the report. Those found guilty would not be spared at any cost, the minister added.

Criminal sections would be added on the basis of irregularities found in investigation report such as overcharging for medicines, forged signature, not providing ambulance on time, overcharging for platelets transfusion, ignoring norms of Indian Medical Association and Medical Council of India, and violation of treatment protocol.

A probe committee constituted to investigate the matter had earlier submitted its report to the health department.  It found “several irregularities” including protocols not being followed in a case related to the death of a 7-year-old girl.  The bill for the treatment of seven-year-old Adya Singh had shot over Rs 15 lakh even as she died of dengue, according to officials. On Friday, Adya’s father had filed a complaint against Fortis Hospital in relation to the death of his daughter due to dengue-related complications.

In his complaint, the deceased’s father Jayant Singh held the hospital responsible for culpable homicide and also alleged forgery, cheating, destruction and alteration of evidence and criminally negligence in the course of her treatment.The matter came to fore in mid-November after a family friend of the deceased girl posted on social media images of the bills of over Rs 16 lakh. The bill included charges for 660 syringes and 2,700 gloves, and triggered outrage among people that the family was overcharged.
