The PIL filed by Assamese scholar Dr Hiren Gohain and two others stated that despite the presence of public videos of alleged hate speeches of CM Sarma, Assam Police has not filed a suo motu FIR.
The pleas were filed by the Communist Party of India (Marxist), CPI leader Annie Raja, and Assamese scholar Dr Hiren Gohain.
The case was related to alleged objectionable remarks made during the 2019 Lok Sabha election campaign.

Tyagi, former Uttar Pradesh Shia Waqf Board chairman who was on bail, was arrested by the Haridwar Police on January 13, 2021 for an alleged hate speech he delivered at a religious congregation in December 2021.
