District and Sessions Judge N Harikumar, while granting the bail, allowed Mamkootathil’s appeal against the dismissal of his bail application by a judicial magistrate's court that had denied him bail, stating that the allegations against him were serious and that he had similar antecedents.
The sessions court Judge, Nazeera S, had, on Wednesday, granted anticipatory bail to Rahul Makootathil, holding that there was no prima facie material to support the survivor’s allegation that the MLA had raped her.
The court heard arguments on the anticipatory bail plea in a closed-door session at the request of both sides. The hearing lasted for more than an hour.
The FIR in the present rape case was registered by the police after the survivor and her family met Chief Minister Pinarayi Vijayan at the Secretariat on Thursday and handed over a written complaint.
The opening day of the session also witnessed heated exchanges during the obituary references, as the NC and the Opposition BJP sparred over late former Governor Satya Pal Malik’s role in the abrogation of Article 370 in 2019.
The delegation, led by LoP Tika Ram Jully, called on the governor in the Raj Bhawan here on Thursday and submitted a memorandum to the latter.
The FIR has been registered on the strict directives of the Madhya Pradesh High Court.
