The Supreme Court, on Thursday, reserved its order on incarcerated Delhi Chief Minister Arvind Kejriwal’s plea for bail and against arrest by the Central Bureau of Investigation (CBI) in an alleged corruption case rooted in now scrapped 2021-2022 Delhi liquor policy case.
Noting that Nair is in jail for the last 23 months, a bench of Justice Hrishikesh Roy and Justice SVN Bhatti said, “The universal proposition of bail being the rule and jail being the exception will be entirely defeated if the petitioner is kept in custody as an under trial for a long duration.”
Granting bail to Kumar, a bench of Justice Surya Kant and Justice Ujjal Bhuyan noted that he is in custody for 100 days and chargesheet has already been filed in the case.
Prem Prakash who is in incarceration for the last 18 months, had moved the top court against Jharkhand High Court order denying him bail in the matter.
