The Election Commission of India on Thursday announced the immediate withdrawal of the Model Code of Conduct (MCC) following the completion of the 2026 Assembly elections in Assam, Kerala, Tamil Nadu, West Bengal and the Union Territory of Puducherry, after the formal declaration of results by Returning Officers in the respective states.
The Election Commission of India (ECI) on Tuesday issued formal notifications constituting the newly-elected Legislative Assemblies in Assam, Kerala, Tamil Nadu and West Bengal, along with the Union Territory of Puducherry, and forwarded them to the respective Governors for further constitutional processes.
A Bench of Chief Justice Surya Kant and Justice Joymalya Bagchi issued the clarification after concerns were raised by the Election Commission whether the admit card could be treated as a standalone proof of identity.
"The BJP's intentions were bad then and remain bad now," he claimed.
The development comes after the Election Commission of India announced elections for 37 vacant Rajya Sabha seats in 10 states.
The fresh directions were issued after the Chief Justice of the Calcutta High Court informed the apex court that around 250 District and Additional District Judges had been assigned the task of examining nearly 50 lakh claims and objections
The ECI has already decided to deploy CAPF personnel in the state even before the announcement of polling dates and the enforcement of the Model Code of Conduct (MCC).
