Telling the petitioner that the issue raised by him is a policy matter falling within the domain of the Central government, a bench of Justice B R Gavai and Justice Augustine George Masih remarked, “… We are accused that we are interfering with the executive and legislative functions.”

The Counsel appearing for petitioner Mathew Thomas urged the bench to hear his arguments in the matter in detail. However, the bench responded that it was not keen on entertaining the plea.
A division bench comprising Chief Justice of Delhi high court D.N. Patel and Justice Jyoti Singh dismissed the petition filed by one Sadre Alam but reserved the judgment for 27 September.
