The victim, Gyanakalpa Mishra, while passing by a display board duly installed with power being provided by the TPCODL came in contact with livewire and died of electrocution way back on 4 September 2009.
Pradhan, represented by a team of lawyers, had filed an Interlocutory Application (IA) seeking dismissal of the election petition filed by Dr. Subash Mohapatra, who had contested his election as a Member of Parliament.
“It is true that the petitioners and their forefathers have been residing in Shantipalli Basti for several decades; however, their occupation of Government land is unauthorised”, the Court ruled in an order pronounced recently.
“Since the grievance so raised in the instant PIL has been redressed by the Government, we do not find any justification in passing any further direction in this regard”, the division bench said.
