By the UP government's order of July 2019, Kafeel Ahmad Khan, a pediatrician, was suspended on charges that he had forcibly treated patients at the Bahraich district hospital and criticized the policies of the government.
The Allahabad High Court set aside the charge sheet and its cognizance order, observing that before filing the charge sheet, the police authorities concerned had not taken the requisite sanction from the Centre or the state government or the DM.
Chief Justice of India SA Bobde, confirming the Allahabad High Court order that freed Dr. Khan said, “Criminal cases will be decided on their own. You cannot use a preventive detention order in another case,”
