SC to hear AAP govt’s pleas over its powers

The Supreme Court on Tuesday agreed to hear next week appeals of the Delhi government on the scope of its various powers in view of the recent judgment by a Constitution Bench which held that the Delhi Lieutenant Governor (LG) has no independent power to take decisions.

A Bench comprising Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud considered the submission of the Delhi government that even after the Constitution Bench’s 4 July verdict the stalemate over the issue of public services was continuing and that needed to be dealt with by an appropriate Bench.

“It will be listed sometime in next week,” the Bench told lawyer Rahul Mehra, representing the Delhi government.

A five-judge Constitution Bench of the apex court, headed by Chief Justice Misra, had laid down broad parameters for the governance of the national capital, which has witnessed a power struggle between the Centre and its representative, the LG, and the elected Delhi government since the Arvind Kejriwal-led Aam Aadmi Party swept to power in February 2015.

The Constitution Bench had, in its verdict, clarified that issues regarding various notifications issued by the Delhi government in exercise of its administrative and legislative powers would be dealt separately by appropriate smaller Bench.

The Kejriwal government in Delhi has been at loggerheads with the two LGs ~ incumbent Anil Baijal and his predecessor Najeeb Jung ~ accusing them of preventing the functioning of the elected state government at the behest of the BJP-ruled Centre.
