India’s refusal to criminalise marital rape rests on a premise that is rarely stated plainly but widely enforced: that consent, once given at marriage, is permanent.
The Supreme Court of India on Friday held that a wife’s alleged failure to perform household chores such as cooking or managing domestic work cannot, by itself, amount to cruelty in matrimonial disputes.
In India, marriage has long been treated as a one-way journey for women. Once a daughter leaves her parents’ home in a wedding procession, social convention dictates that she must endure whatever awaits her in her husband’s household.
