The Central Bureau of Investigation (CBI) has filed supplementary chargesheet against former Shimla Superintendent of Police (SP) DW Negi, accusing him of shielding real accused in Gudia gangrape and murder case.

The CBI had earlier filed chargesheet against eight police officers, including IGP Zahur Zaidi who was heading the Special Investigation Team (SIT) constituted to probe the ghastly rape and murder.

Negi has been charged under Sections 302, 330, 331, 348, 323, 326, 218, 201, 195, 196 and 120-B of the Indian Penal Code (IPC), same offences under which other SIT members were booked and he had named as main conspirator in the case.

Negi, who arrested on 16 November, was chargesheeted for his role in the death of Suraj, one of the six persons arrested for rape and murder by the HP Police on 13 July.

The 15-pages long chargesheet accuses Negi of conspiring to hide facts in custodial death of Suraj as after coming to know about his death, he had met Zaidi and co-accused in the case, Rajender was falsely booked for murdering him.

Out of five accused in the case, the CBI had given clean chit to four accused including Rajender Singh alias Raju, Lokjan, Subhash Singh Bisht and Deepak while another accused, Ashish Chauhan is reportedly still not out of the agency’s radar.

Though all of them are presently out on bail. Following public outrage over ghastly crime, the government had constituted a SIT which had arrested six persons, Ashish Chauhan, Rajender Singh alias Raju, Deepak, Subhash Singh Bisht, Suraj and Lokjan for the ghastly crime on 12 and 13 July.

The cops had allegedly tortured five accused, excluding Ashish Chauhan to confess that they were involved in gangrape and murder.

The torture had resulted in the death of Suraj on the intervening night of 18-19 July and investigations had revealed that Suraj was severely thrashed after he had demanded one more chapatti in dinner.

On 19 July, the HP High Court had directed the CBI to probe into the Gudia case, along with custodial death case and on 29 August, eight members of Special Investigation Team (SIT) were arrested for the custodial death.
