Appearing for the Union government, Solicitor General (SG) Tushar Mehta submitted before a Bench of Justices Aravind Kumar and Prasanna B. Varale that Wangchuk’s medical condition has been periodically reviewed and there was “nothing alarming” warranting his release.
The decision was delivered by a division bench of Justices Siddharth and Jai Krishna Upadhyay on Friday.
The rulings were issued this week in separate cases in the Eastern and Southern Districts of California. In each case, the courts found that Immigration and Customs Enforcement failed to follow basic due process requirements before re-arresting the men.
A controversial provision, it has been challenged, most recently in the Supreme Court, on grounds of its constitutional validity for being in contravention of Article 21 of the Constitution of India
The habeas corpus plea was filed by mahout Saddam seeking the release of the 47-year-old elephant.
