In a landmark judgement, the Allahabad High Court has said that the house where parents are insulted is not a house but a place of injustice. “The court cannot be a silent spectator to the increasing trend of leaving old parents helpless. Ignoring parents is not only a sin but also a crime in law,” the court commented.

A division bench of the court comprising Justices Mahesh Chandra Tripathi and Prashant Kumar made these comments while delivering a verdict in a case from the Sant Kabir Nagar district recently.

According to the case, the land of the petitioner Ram Dular Gupta was acquired by the National Highway, and in lieu of this, a compensation amount of Rs 21,17,758 was fixed in his favour, but his son claimed his right on it and started misbehaving with him. The petitioner had knocked the doors of the High Court against the act of his son.

The court accepted the petition of the elderly and said that there can be no bigger social degradation than when the children themselves turn away from the silent suffering of their parents. This is gross moral bankruptcy. The court found that the elderly petitioner is the real owner of the acquired property. Therefore, the court ordered the entire amount of compensation for the acquired land to be paid to the petitioner.

The bench also commented that parents spend the golden years of their lives in raising their children. Later, when they need support, the same children abandon them. This is not only inhumane, but also a violation of the right to live with dignity under Article 21.
