Setback for Kerala govt: CAT quashes transfer of non-IAS officers to IAS cadre posts

The Kerala government has suffered a major setback in connection with the transfer and postings of IAS officers. The Kochi bench of the Central Administrative Tribunal (CAT) on Friday quashed three transfer orders, issued by the state government, appointing three non-IAS officers to IAS cadre posts, observing that it is illegal to appoint non-cadre officers to the IAS cadre posts.

Quashing the transfer orders, the CAT said appointing non-cadre officers to the IAS cadre posts is illegal. Only IAS officers should be appointed to cadre posts, the Tribunal said. The 2014 Cadre Rules should be strictly followed, it added.

The Tribunal has also ordered that the permission of the Civil Service Board is required for the transfer of IAS officers.

The Tribunal noted that the post of Excise Commissioner is an IAS cadre post and only IAS officers should be appointed in the post. The CAT order is a setback for current Excise Commissioner ADGP MR Ajit Kumar, who is an IPS officer .
