The Rajasthan High Court on Monday asked Assembly Speaker Dr C P Joshi to clarify the facts on the resignation of letters of 91 MLAs to the court by January 16.

The Division Bench of Chief Justice Pankaj Mithal and Justice Shubha Mehta considered the petition of Advocate General M S Singhvi, which sought more time to file a reply on behalf Speaker Dr Joshi, who was served a show cause notice on December 6 to file reply within three weeks on the en masse resignation of 91 MLAs on September 25, 2022.

Quoting today’s proceedings to media in a statement here, Rajendra Rathore, Deputy Leader in the House and the petitioner, said: “On seeking the time to reply by Advocate General Singhvi, the CJ said: You can be given time but you have to tell the court whether the decision on resignations can be kept pending indefinitely? You will have to take a decision in this regard as per the applicable rules and procedure.”

“The CJ gave oral instructions to the Advocate General to take a decision on the resignation letter of 91 MLAs within 10 days and before the next assembly session beginning on January 23, and clarify the facts on the resignations,” Rathore, who himself pleaded his case in the court, said.

It is notable that Chief Whip of the ruling Congress and PHED Minister Dr Mahesh Joshi, Deputy Whip Mahendra Choudhary, CM’s Advisor Sanyam Lodha and Parliamentary Affairs and UDH Minister Shanti Dhariwal had handed over the resignation of 91 MLAs to the Speaker after three hours of political drama at Dhariwal’s residence in September last year when Congress observers Ajay Makan and Mallikarjun Kharge had come to hold the CLP meeting.
