Veteran actor Moushumi Chatterjee and her husband Jayanta Mukherjee have approached the Bombay High Court seeking access to their comatose daughter Payal. She got married to Dicky Mehta, a businessman, in 2010.

Senior counsel Beni Chatterjee, appearing for the actor, mentioned the petition before a division bench of Justice B P Dharmadhikari and Justice S V Kotwal. The bench posted it for hearing on Saturday. The court also directed Moushumi Chatterjee’s son-in-law, Dicky Mehta, to file his affidavit in response to the petition.

Payal, who has suffered from juvenile diabetes, had to constantly visit the hospital since April 2017 because of deteriorating health. “She has been persistently in bed in a comatose condition,” says the petition.

On April 28, 2018, Dicky’s family got Payal discharged from the hospital for home care.

“The doctors advised physiotherapy and progressive changes in her diet so that the tube through which she was being fed could be removed and she could regain the faculty of speech,” the petition read.

Moushumi and Jayanta claim that Payal’s diet has not been changed according to doctors’ instruction, adding that they have been denied copies of her medical reports and even her physiotherapy treatment.

The petition says they do not know anything about Payal’s current state since Dicky has “begun preventing them from visiting her by alleging that since he is her lawfully wedded husband and he has acquired a greater right to care for her than the parents”.

Jayanta, Payal and Dicky were directors of Tethys Business and Projects Private Limited till December 2016 after which a dispute over the management created differences among the family members.
