In yet another setback to incarcerated activists Umar Khalid and Sherjeel Imam, a Delhi court on Saturday rejected their regular bail applications in the 2020 Delhi riots larger conspiracy case.

After hearing arguments from both Imam and Khalid, Additional Sessions Judge (ASJ) Sameer Bajpai of the Karkardooma Court dismissed their pleas.

Khalid and Imam are in jail in connection with a Unlawful Activities (Prevention) Act (UAPA) case linked to the northeast Delhi riots in 2020.

Earlier last month, the trial court had sought Delhi Police’s response on their bail pleas.

Imam had sought the bail on grounds that there has been no meaningful progress in their trial even after six months of the Supreme Court order rejecting his bail application.

He argued that he has been behind bars for nearly six years and still arguments on the question of framing of charges have not yet been concluded.

Earlier in January this year, the Supreme Court dismissed the bail pleas of Khalid and Imam, holding that the prosecution material disclosed prima facie grounds attracting the statutory embargo on the grant of bail under Section 43D(5) of the UAPA.

However, the top court had granted bail to five other accused in the case — Gulfisha Fatima, Meeran Haider, Shifa Ur Rehman, Mohd Saleem Khan and Shadab Ahmed.

The case pertains to the alleged larger conspiracy behind the February 2020 northeast Delhi riots and is being investigated under the provisions of the UAPA and other penal laws.
