Delhi BJP spokesperson Praveen Shankar Kapoor, who is also the General Secretary of Chandni Chowk Citizens’ Forum, on Saturday stated that while it is essential to curb dangerous and illegal constructions, it is equally important to fully respect the observations made by the Supreme Court. He emphasized that only those constructions which follow the rules and have approved building plans should be allowed.

Referring to the Delhi Master Plan 2021, Kapoor stressed that the designated residential or commercial land use for specific roads and lanes must be strictly adhered to. He added that the required fees must be paid to the Municipal Corporation of Delhi (MCD) to ensure that constructions are legal and in compliance with the law.

Kapoor urged MCD Mayor Sardar Raja Iqbal Singh, Commissioner Ashwani Kumar, and the Delhi Police Commissioner to direct the civic body to immediately approach the apex court and seek clarification on what constitutes “illegal construction.”

He further said that the court should be informed that both the Central and Delhi governments have instructed the Delhi Police to refrain from interfering in construction activities that are lawful.

Additionally, he said, the MCD should get clarity on whether buildings being constructed as per approved plans, lawful repair works, and commercial constructions or uses on roads designated as Pedestrian Shopping Streets, Mixed Land Use Streets, or Fully Commercial Streets under the Master Plans, are also considered illegal by the court.
