Ashish Kapoor accused in gang rape case: Tis Hazari Court transfers TV actor’s matter to sessions court for trial

Delhi’s Tis Hazari Court has sent high-profile gang rape case involving TV actor Ashish Kapoor to sessions court for trial. The matter already heavy with accusations and counter-claims is now entering its most crucial phase.

According to case details, FIR was registered at Delhi’s Civil Lines police station on August 11, 2025. The complaint came from a woman who said she attended a party in Ashish Kapoor’s neighbourhood, where she met the actor and his friends for the first time.

The complainant alleged that she was made to consume a drink mixed with some substance, after which she lost consciousness. She claimed that she was then dragged into washroom and was allegedly gangraped.

Based on her complaint, police booked the accused under sections related to rape, gang rape and causing hurt.

Police action and chargesheet

Delhi Police moved ahead with investigation and filed chargesheet in November 2025. The chargesheet was filed under Section 64(1) of the Bharatiya Nyaya Sanhita (BNS) which deals with rape.

Along with Ashish Kapoor, two other people, Kapil Gupta and Ritu Gupta, were named as accused in the case.

All three accused are currently out on bail.

Court sends case to sessions court

After reviewing the chargesheet and related documents, Judicial Magistrate First Class (JMFC) Kartik Taparia passed an order committing the case to the court of sessions. The order was pronounced on January 15.

In his order, the magistrate stated that the offence under Section 64(1) BNS is exclusively triable by the sessions court. He directed that the matter be placed before the Principal District and Sessions Judge on January 22, 2026, at 2:00 PM.

The public prosecutor was also informed of the development.

Interestingly, while granting bail to Ashish Kapoor earlier on September 10, the court had raised concerns about lapses in the investigation. The judge noted that despite police custody remand, there were no serious efforts to recover the accused’s mobile phone.

The court also observed that no lawful searches were conducted and that there was nothing on record to show that Ashish Kapoor did not cooperate with investigators.

Advocate Deepak Sharma, appearing for Ashish Kapoor, strongly argued that the allegations were false. He claimed that the case was filed with the intention of extorting money.

The defence also told the court that the complainant was a habitual litigant and had earlier filed a complaint against her landlord at Janakpuri police station in the same year.

Arrest in Pune and legal twists

Ashish Kapoor was arrested in Pune, Maharashtra, on September 2, 2025. His plea seeking interim protection from arrest became irrelevant after the arrest was made.
