Unnao custodial death case: Delhi HC refuses to suspend Kuldeep Singh Sengar’s sentence

In a setback to Kuldeep Singh Sengar, the Delhi High Court on Monday refused to suspend the sentence of the former BJP MLA in the Unnao custodial death case.

The order came in the case of the custodial death of the father of the Unnao rape survivor.

Sengar has been in custody since April 13, 2018 and is serving 10 years jail term in the Unnao rape survivor’s father’s custodial death case.

The judgement in the case was reserved by the Delhi HC bench of Justice Ravinder Dudeja on November 6 last year.

The Delhi High Court had earlier granted Sengar bail in the minor’s rape case on December 23. But the HC verdict was later on December 29 stayed by the Supreme Court following outrage.

The rape survivor’s counsel, Advocate Mehmood Pracha had argued in the court that Sengar should not get bail as there remains a threat to the victim and to her family.

The High Court had granted bail to Sengar accepting his legal team’s argument that without aggravated assault, the law mandates a minimum seven-year jail term. This sentence has already been served by Sengar. The court had then suspended the ex-MLA’s sentence and granted him bail.

Senger was found guilty in the custodial death case by the Tis Hazari Court in 2018. In the minor’s rape case, he is serving a life sentence.
