The Supreme Court on Monday recalled its earlier order granting former finance minister P Chidambaram interim relief till September 5 and will now hear his plea challenging non-bailable warrant against him and remand orders of the trial court in the INX Media case on Tuesday.

This came after Solicitor General Tushar Mehta urged the court to hear Chidambaram case tomorrow.

He said the CBI would seek custody for one more day and the court can hear Chidambaram’s plea tomorrow.

In its pre-lunch order, the Supreme Court had extended the CBI custody of former finance minister P Chidambaram till September 5 even as it told the Congress leader to approach the trial court for interim bail in the INX Media case.

Sending Chidambaram to the custody of the Central Bureau of Investigation till Thursday, the apex court had said the status quo should be maintained till then if the trial court rejects his bail plea.

Chidambaram’s counsel Kapil Sibal said the senior leader must not be sent to Tihar jail but placed under house arrest as he is a 74-year-old man.

Sibal told a bench led by Justice R Banumathi that his petition against the CBI remand would become “infructuous” if the Delhi Court sends him to Tihar jail at the end of his CBI custody later in the day.

Taking into consideration the request made by Chidambaram, the Supreme Court ordered that he be not be sent to Tihar jail but kept in CBI custody.

The government’s counsel objected to Sibal’s plea and said it was not possible under the law. However, Justice R Banumathi accepted Sibal’s petition, Live Law reported.

The former finance minister was arrested by the CBI in connection with the INX Media case on August 21.

In an unprecedented plea, Chidambaram had on Thursday offered in the Supreme Court to remain in CBI custody till September 2 in the case.

Meanwhile, the Supreme Court will pronounce its order on September 5 on the anticipatory bail plea of Chidambaram in a case being probed by ED in INX Media scam and directed that documents linked to the case be submitted under an authenticated sealed cover.

The Supreme Court is hearing a plea filed by P Chidambaram challenging the August 20 verdict of the Delhi High Court denying him anticipatory bail in the INX Media corruption and money laundering cases lodged by the CBI and ED.

The ED has maintained that it needed custodial interrogation of the former minister to unearth the larger conspiracy in the INX Media money case under the Prevention of Money Laundering Act or PMLA.

Chidambaram was arrested on the night of August 21 amid high drama by CBI officials at his residence. His arrest came after the Delhi High Court rejected his pre-arrest bail.

The INX Media case relates to alleged irregularities in Foreign Investment Promotion Board (FIPB) clearance given to the media group for foreign investment to the tune of Rs 305 crore in 2007 when Chidambaram was finance minister.
