Revision petition filed in Rahul Gandhi defamation case; MP-MLA Court order challenged

Sultanour, May 21: A revision petition has been filed in the defamation case related to Congress MP and leader of the opposition in the Lok Sabha Rahul Gandhi in Sultanpur court on Thursday.

The counsel for BJP leader Vijay Mishra filed a revision petition in the Sessions Court, challenging an order issued by the lower court.

Rahul Gandhi’s counsel, Kashi Prasad Shukla, stated that the complainant, Vijay Mishra, has challenged the lower court’s order in which his request to collect certain samples as evidence was rejected. This revision petition is currently pending before the court of ADJ-V (Additional District Judge-V).

The ADJ Court has scheduled May 30, 2026, as the date for the hearing on this revision petition. The court has also summoned the case file pertaining to this matter.

Meanwhile, the next hearing for the original defamation suit is scheduled to take place in court on June 17. This revision petition has been filed against the lower court’s order dated May 2. Specifically, on May 2, the court had rejected an application submitted by the complainant’s counsel seeking permission to collect samples to be used as evidence.

Advocate Santosh Pandey had sought time from the court to file the revision petition, citing the non-receipt of a certified copy of the said order.

The defamation case was filed by BJP leader Vijay Mishra in October 2018. In connection with this case, Congress MP Rahul Gandhi had surrendered before the court on February 20, 2024. Subsequently, the Special Magistrate granted him bail upon furnishing two personal bonds of ₹25,000 each.

On July 26, 2024, Rahul Gandhi appeared before the MP/MLA Court and recorded his statement. Asserting his innocence, he termed the case a “political conspiracy.” Following Rahul Gandhi’s statement, the court had directed the plaintiff to present evidence. Since then, witnesses have been continuously produced.

Prior to this, on February 20, Rahul Gandhi had also recorded his statement before the MP/MLA Court under Section 313 of the CrPC. The court had asked him to present an explanation and evidence regarding his innocence. However, Rahul Gandhi’s counsel, Kashi Prasad Shukla, did not present any explanation or evidence before the court.
