In a major relief to Samajwadi Party, the Allahabad High Court Thursday stayed the district administration’s order directing the party to vacate its Moradabad office till further notification.
The hearing took place before a division bench of Justice Arindam Singh and Justice Satyaveer Singh. The next hearing in the case will be held on October 28.
The district administration had issued a notice to the Samajwadi Party to vacate the Moradabad office till October 10. The party filed a petition in the High Court challenging the district administration’s order.
The allotment of the SP office was canceled by the administration on September 16. The notice issued by the administration stated that it was Nazul land, which falls under the jurisdiction of the Municipal Corporation.
On July 13, 1994, the office was allotted to the then Chief Minister Mulayam Singh Yadav at a monthly rent of ₹250. After Mulayam Singh Yadav’s death, the SP failed to transfer the building to its name, which has now led to the administration taking formal possession of the property.
ADM Finance Mamta Malviya had previously issued a notice to the SP District President, stating that the building must be vacated and handed over to the district administration within a month, failing which a fine of ₹1,000 per day would be imposed.
According to government orders, the allotment of any residential or commercial building should not exceed 15 years, whereas the SP building in question has been in operation for over 30 years. This is why the administration has now decided to take action and initiated the process of taking possession of the building from the Municipal Corporation.
