Rajasthan Assembly passes Bill on death for rapists of girls under 12

The Rajasthan Assembly on Friday passed a Bill calling for death penalty for those guilty of raping girls below the age of 12. The passage of the Bill makes Rajasthan the second state after Madhya Pradesh to introduce such a law.

It was Rajasthan Home Minister Gulab Chand Kataria who had earlier informed the Rajasthan assembly of the intent of the BJP government to introduce a law similar to that of the December 2017 Madhya Pradesh bill.

Speaking to reporters, Kataria said that life sentence and life imprisonment have been added for convicts in offences against girls below 12 years of age and that a provision has been made that convict can’t leave the prison for life even after completing 14 years of sentence.

According to reports, the Criminal Laws (Rajasthan Amendment) Bill, 2018, which was tabled in the assembly on Wednesday, seeks to add section 376-AA in the Indian Penal Code (IPC).

“Whoever commits rape on a woman up to twelve years of age shall be punished with death, or rigorous imprisonment for a term which shall not be less than fourteen years but which may extend to imprisonment for life which shall mean imprisonment for the remainder of that person’s natural life, and shall also be liable to fine,” the Indian Express quotes from the Bill.

A similar provision, 376-DD, will be added for gang rape.
