The Supreme Court on Thursday observed that the ground situation has to be taken into consideration while granting statehood to Jammu and Kashmir.
Hearing a batch of pleas seeking direction to the Centre to restore the statehood of the Union Territory of Jammu and Kashmir, Chief Justice of India (CJI) BR Gavai said, ”
“You cannot ignore what happened in Pahalgam.”
“You cannot ignore what happened in Pahalgam.”
Solicitor General Tushar Mehta, appearing for the Centre, told the court that while the government had assured restoration of statehood in Jammu and Kashmir after assembly elections, there is a peculiar situation there.
Mehta also sought eight weeks time to take instruction from government on the issue.
After this, the apex court asked the centre to respond to the pleas seeking statehood restoration in Jammu and Kashmir within eight weeks.
Following the abrogation of key provision of Article 370 on August 5, 2019, the erstwhile state of Jammu and Kashmir was bifurcated into two separate Union Territories – Jammu and Kashmir with legislature and Ladakh.
