Allahabad HC stays lawyer’s arrest

A special bench of the Allahabad High Court sat on Sunday, a holiday, and stayed the arrest of a lawyer, Awadhesh Mishra.

The special bench was constituted on the orders of Chief Justice Arun Bhasin, and the hearing took place before a division bench comprising Justice J J Munir and Justice Sanjiv Kumar.

After hearing the petition filed by Farrukhabad lawyer Awadhesh Mishra, the special bench of the High Court stayed his arrest until the next date of hearing and issued a directive to the Registrar of Compliance in this regard.

The next hearing in the case is scheduled for October 29.

The High Court directed that a copy of the order be issued to the Farrukhabad SP and the Fatehgarh Kotwali SHO through the Farrukhabad CJM.

An FIR was filed against Awadhesh Mishra in Fatehgarh Kotwali on October 11. It was contended that Farrukhabad SP Aarti Singh had ordered the filing of the FIR with malicious intent.

This FIR was filed against the lawyer following the court’s directive on October 9 in a habeas corpus petition filed by Preeti Yadav.

According to the FIR, Awadhesh Mishra had demanded ₹5 lakh from a petitioner in a case filed in 2020.
