Allahabad HC dismisses a petition seeking state intervention in dispute over Tazia

A division bench of the Allahabad High Court dismissed a petition seeking state intervention in a dispute between two factions of the Muslim community over bringing out Tazia in Prayagraj city.

The court maintained that the state has no role in interfering with the Moharram procession.

The bench comprising Justice J Munir and Arun Kumar, said that Chief Standing Counsel Manoj Singh informed them that written instructions from Prayagraj police on June 23 stated that for the present year, the Government or the Administration has no objection to taking out the Muharram processions.

The bench said it appears that the Waqf Tazia Kalan have resolved not to take out a procession this year.

This petition has been filed by the Allahabad Atehasik Moharram Committee registered through its President Asrar Ahmad Niyazi asking for state’s interference.

The judges maintained that the issue whether the Muharram procession is to be taken out this year or not, is a matter inter se the petitioner and the other members of the Muslim community. It has nothing to do with the State. Therefore, no further orders are required to be made in this petition , the bench said while dismissing the petition.
