The Allahabad High Court has rejected the bail plea of Rehan, an associate of riot accused Maulana Tauqeer Raza, in the September 26 Bareilly riots case.
The court said that the slogan “Sir Tan Se Juda” (Separate head from body), raised during the ‘I Love Mohammed’ procession, was not only an attempt to incite riots but also amounted to a challenge to the government.”
A single bench of Justice Arun Kumar Singh Deswal dismissed the bail plea.
An FIR was lodged against Rehan at the Kotwali police station in connection with the Bareilly riots. The case was lodged for inciting riots and raising slogans of ‘separate head and body’.
The court has said in paragraph 12 of the judgment that the slogan raised by the petitioner was ‘Gustakh e Nabi ki Ek Punishment, Sir Tan Se Juda Sir Tan Se Juda’.
“The slogan challenges the authority of law and the sovereignty and integrity of India by inciting armed rebellion, making it punishable under Section 152 of the BNS. It is also contrary to the fundamental principles of Islam,” the court added.
After hearing both parties, the court rejected the bail application of petitioner Rehan.
Petitioner’s advocate Akhilesh Kumar Dwivedi presented his side on the bail application. Additional Advocate General Anoop Trivedi strongly opposed the bail application.
