The Taj Story: Delhi HC defends ‘creative freedom’, dismisses communal threat concerns

The Delhi High Court on Wednesday dismissed a Public Interest Litigation (PIL) filed against the soon-to-be-released film ‘The Taj Story’, calling it an unnecessary attempt to interfere with artistic freedom. The court made it clear that creative expression cannot be curtailed without strong, valid reasons.

The plea filed by advocate Shakeel Abbas and BJP leader Rajnish Singh sought to delay or regulate the film’s release alleging that it distorted historical facts and might disturb communal harmony.

The petitioners had also requested that the matter be listed urgently citing the film’s release date on October 31. However, the court refused to take up the matter immediately saying it would be heard in its regular course as per procedure.

According to sources, the court maintained that films, as a form of art, are protected under the right to free expression. It added that any interference should be based on substantial grounds, not assumptions or speculative fears.

Reacting to the controversy, director Tushar Amrish Goel said the film was made after months of careful research and verification.

“’The Taj Story’ is not based on imagination or rumours,” Goel said in a statement. “Our team spent six months researching, consulting experts, and studying authentic historical references. The Central Board of Film Certification (CBFC) also examined the film thoroughly before approving it.”

Goel further added that the movie’s intent was not to create conflict but to present a researched viewpoint that encourages public discussion. “We respect the Delhi High Court’s decision. Cinema should always be a space for truth, exploration, and fearless storytelling,” he said.

Producer CA Suresh Jha echoed the same sentiment calling the allegations “completely baseless”.

“We have made this film with honesty and responsibility,” Jha said. “Our goal is not to divide people but to tell a story that invites curiosity and pride in our history.”

What did the PIL allege?

The PIL had alleged that ‘The Taj Story’ relied on unverified theories that could mislead viewers about historical facts. It also expressed concern that such portrayals might disturb communal peace, particularly in Agra, home to the Taj Mahal.

The petitioners urged the court to direct the Central government and CBFC to re-examine the film’s certification. They also demanded the inclusion of disclaimers and restrictions to ensure that the film does not trigger unrest.

‘The Taj Story’ features cast including Paresh Rawal, Zakir Hussain, Amruta Khanvilkar, Sneha Wagh, and Namit Das. The specific plot details remain under wraps.

The movie is set for nationwide release on October 31.
