The Kerala High Court on Tuesday came down heavily on the police over its flaws in the probe into the murder of Youth Congress leader Shuhaib near Mattannur in Kannur district last week.

The court, while considering a petition filed by Shuhaib’s parents C P Mohammad and S P Razia, seeking a CBI probe into the murder, asked the police why the weapon used for the murder hasn’t been found till date.

Regarding the reports that the details of the probe were being leaked, the court observed that the allegations of the investigation details being leaked is a serious matter Referring to the Kannur SP’s recent reported remarks that there are spies in the police department, the court said “The police should make it clear on what basis the superintendent of police had remarked that there were spies in the ranks.”

The judge, while considering the petition, raised a picture showing Shuhaib lying in a pool of blood and asked “How could someone kill a person like this.” The picture was submitted in court by the petitioners.

Shuhaib’s parents told the court that the investigation is not satisfactory, the probe is being conducted according to CPI-M’s interest.

The petitioners said now what is happening in Kannur is the terrorist activities by the ruling party. They also alleged that the police have not invoked UAPA in the case, even though bomb was used in the attack. They also reminded the court about the photos of the accused together with Chief Minister PinarayiVijayan and CPI-M Kannur district Secretary P Jayarajan.

When the state attorney said that the petitioners’ counsel was making a political speech, the court observed that the counsel’s argument was a statement of facts. The CBI told the court they will inform regarding taking over the case within a week.
