Court to hear CBI plea in Bofors case on 11 May

A Delhi court has decided to hear on 11 May a plea by the CBI for a direction to allow it for further investigation in the Rs 64 crore Bofors payoff case, a politically sensitive matter.

Additional chief metropolitan magistrate Anuj Agarwal, who took up the matter on Saturday, fixed the hearing on 11 May. He noted that the concerned file with the original records relating to the case was with the Supreme Court which had not come yet.

Earlier on 17 February, the court had deferred the case for Saturday (April 7) owing to the unavailability of the documents provided to the apex court as it is in possession of an appeal by BJP leader Ajay Agrawal. The BJP leader has challenged the 31 May 2005, decision of the Delhi High Court which quashed all charges against those accused in the case.

Ajay Agrawal contested the 2014 Lok Sabha election from Rae Bareli against the then Congress chief Sonia Gandhi. He filed the appeal in the Supreme Court when the CBI failed to challenge the High Court verdict in the apex court within 90 days as the mandatory period.

On 1 February, the CBI had moved the trial court pleading for permission for a further probe in the matter, observing that it had found fresh material and evidence relating to the matter.

Advocate Ajay Agarwal on 7 April told the court during the hearing that the Supreme Court was likely to constitute a new bench to hear the matter soon as Justice AM Khanwilkar has recused himself from the case.

+On the next date of hearing, the court will also consider his plea asking it for permission to the CBI to go in for a further probe in the case.
