Justice Ashim Kumar Roy&’s Division Bench on Monday, for the second time, rejected the CBI&’s plea for urgent hearing in the Madan Mitra bail cancellation case. CBI special counsel K Raghavacharyulu mentioned before Justice Ashim Kumar Roy&’s Division Bench that the bail cancellation petition of Madan Mitra by the CBI be treated as an “urgent” matter and be heard. Justice Ashim Kumar Roy&’s Division Bench observed, “The court does not see any urgency in the matter, so it would be heard as it appears on the list.” After the Division Bench of Justice Roy rejected the prayer of the CBI, CBI special counsel mentioned the matter before Chief Justice Girish Gupta&’s Division Bench for an early hearing of the Mitra case.

Special counsel K Raghavacharyulu also mentioned that their prayer was rejected twice by Justice Ashim Roy&’s Division Bench, thus this court should intervene in view of the seriousness of the case. However, Chief Justice Girish Gupta&’s Division Bench directed the CBI to file a proper application for taking appropriate decision in this connection.The CBI was told to file a written application as soon as possible. On 13 September, the CBI moved Calcutta High Court for cancellation of the interim bail granted to Mitra by the additional district and sessions judge Uttam Kumar Nandi on 9 September.

The CBI petition stated that the district and sessions judge had granted interim bail to Madan Mitra without observing his past record. He stated, “The case is at an advance stage and a dayto-day report of the investigation is filed. The interim bail order is arbitrary,illegal, unjustified and contrary to the law. The interim bail order is misuse of judicial power. The said judge has suppressed the actual facts while delivering the order.’’ “In the same case the bail plea of Matang Sihn and Manaranjana Sihn had been cancelled.

Thus Mitra&’s bail should also be cancelled. The accused may flee away from the judicial proceedings and also tamper with evidence and influence witnesses. There is larger public interest involved and there have been change in circumstances.
