The 21st Metropolitan Magistrate, Mr Arvind Mishra, today rejected the prayer of Sarada scam accused Kunal Ghosh and Debjani Mukherjee to stop the ongoing investigation into the case and to discharge them.
The magistrate also directed that the CBI will carry on their investigation as they have been continuing.
On 22 July Saradha scam accused Debjani Mukherjee’s and Kunal Ghosh&’s counsel had submitted separate petitions in the court of 21 Metropolitan Magistrate Arvind Mishra, city sessions court stating that according to the Criminal Procedure Code the investigation must be concluded in two years.
If no charges are brought by 30 July 2016 then they should be discharged, they had submitted.
Advocate Anirban Guhathakurta , counsel for Debjani Mukherjee submitted: “The investigation must be concluded within two years from the date of arrest of the accused. On 30 July 2014 my client was arrested, thus on 30 July 2016 two years of the case is completed. Till date there is no crucial development in the case.
I’m appealing to the court to call for the case diary and if no allegation is found against my client in investigation till 30 July then discharge my client from the case.
Meanwhile, the jail superintendent of Presidency jail has been asked to be present in court on 20 August to explain his position as to why he has asked for Kunal Ghosh to be shifted to another jail.
