Union Cabinet clears ‘Triple Talaq’ Bill, to be tabled in Winter Session

The Cabinet cleared a draft law that criminalises instant ‘Triple Talaq’, a divorce practice among Muslims on Friday, ahead of it being taken up during the Parliament’s Winter Session.

The controversial practice allows Muslim men to divorce their wives by pronouncing ‘Talaq’ (divorce) three times.

The Islamic ‘divorce’ practice of instant Triple Talaq (talaq-ul-biddat) had been declared “unislamic, arbitrary and unconstitutional” by Supreme Court earlier this year and had instructed the Union government to introduce a law in this regard during this period.

The draft was prepared by an inter-ministerial group headed by Home Minister Rajnath Singh. The other members included External Affairs Minister Sushma Swaraj, Finance Minister Arun Jaitley, Law Minister Ravi Shankar Prasad and his junior in the ministry P P Chaudhary.

The draft law proposes three year jail-term for husbands and to make it a cognizable and non-bailable offence. The draft bill will also recommend the right to seek compensation and maintenance for children.

Meanwhile, the Muslim Women Bill will now be tabled in the ongoing Parliament Winter session, which began on Friday.

The Muslim Women (Protection of Rights on Marriage) Bill, 2017 — The bill has been popularly called a bill on ‘Triple Talaq’, a form of divorce orally among the Muslims, and according to government sources has provision for punishment for such form of divorce. According to PRS Legislative Research, the bill will give women the right to seek maintenance in case of Triple Talaq.
