The order on the bail plea of Chhatradhar Mahato convener of People’s Committee Against Police Atrocities PCPA and others was reserved by the Division Bench of Justice Asim Roy and Justice Moloy Marut Banerjee of Calcutta High Court on Thursday.
The others who are seeking bail are Sambhu Soren Sukhsanti Baske Sabari Murmu Raja Sarkhel and Prasun Chatterjee.
Apart from Raja and Prasun the rest have been awarded life imprisonment by a trial court. These two persons have been given a 10-year prison term.
While moving the bail petition on behalf of the sentenced persons Sekhar Basu submitted that there was no proper sanction to charge the accused under Unlawful Activities Prevention Act and that there is no conformity between the seizure list and the account of the witnesses leading to conviction of the accused persons
During the trial the account of the witnesses did not tally with the goods seized from Mahato like gelatin sticks it was submitted. Proper sanction was taken before charging the accused with UAPA Act public prosecutor Manjit Singh submitted opposing the defence counsel’s submission. Maoist literature together with ammunition were seized from Mahato it was submitted.
On 13 May 2015 Chhatradhar Mahato the face of the Lalgarh movement in the state and the convener of People’s Committee Against Police Atrocities and five others were given life imprisonment after holding them guilty under the Un lawful Activities Prevention Act UAPA for their alleged links with Maoists.
Fourth Additional District and Sessions Judge Kaberi Bose passed the order against Mahato and his associates holding them guilty and convicted them under several charges including that of waging war against the state.
